Zoning Appeal

Overview

This document is a form for filing an appeal to the Zoning Hearing Board of Ebensburg Borough, Pennsylvania. It is designed for property owners or appellants to request a review of a decision made by the Zoning Officer, seek a variance, or apply for a special exception.

Form Instructions

The first page of the document is the application form itself, requiring the following information:

• Appellant Details: Name, mailing address, and telephone number.
• Subject Property: The name of the owner, the specific address/location, and the current zoning classification.
• Type of Request: The appellant must check one of three boxes to specify the nature of the appeal:
  • Appealing a decision of the Zoning Officer.
  • Seeking a variance from specific terms.
  • Seeking a special exception under specific terms.
• Justification: A written explanation of the request and the reasons why the appeal should be allowed.
• Signatures: The form must be signed and dated by the appellant.

Required Attachments

The second page outlines specific documents that must be submitted along with the application:

• Zoning Officer’s Decision: A copy of any opinion or decision rendered by the Zoning Officer.
• Plot Plan: A scaled plan of the real estate that includes:
  • All bordering streets.
  • Lot size and dimensions.
  • Location, footprint, and size of existing buildings/improvements.
  • Location, footprint, and size of proposed buildings/improvements.
  • Exact dimensions for lot lines, building lines, existing setbacks, and proposed setbacks.
• Neighbor Notification List: A list of all property owners on the same block and those on the opposite side of any contiguous streets. This list must include stamped, pre-addressed envelopes for notification purposes.
• Filing Fee: The necessary fee must be enclosed, made payable to Ebensburg Borough. Note that the appellant may be billed for additional costs or receive a refund if the fee exceeds actual administrative charges.

Scheduling and Submission

• Meeting Schedule: The Ebensburg Zoning Hearing Board meets on the 4th Wednesday of each month at 7:00 p. m.
• Submission Deadline: To be scheduled for a hearing, the application, fee, and all attachments must be submitted to the borough office on or before the first Friday of that month. This deadline allows time for advertising as required by the Commonwealth’s Municipal Planning Code.
