Chapter 5: Conduct – Part 1: Curfew (Ebensburg, PA) This section of the borough’s code regulates when minors may be out in public spaces and outlines consequences for violations. Who Is Covered? Minors under 18 years of age. When Are They Restricted? Between 11:00 p. m. and 5:00 a. m. , local time. Applies to streets, alleys, parks, and other public places within the Borough — unless an exception applies. Exceptions Minors are allowed out during curfew hours if: Accompanied by a parent, guardian, or other person with legal custody. Violations & Penalties If found violating curfew, police will take the minor into custody and return them to their parent, guardian, or custodian. Repeat offenders (more than three violations) will be reported to the Juvenile Court of Cambria County as incorrigible or delinquent. Age Determination Police officers use discretion to determine a minor’s age. In doubtful cases, they may require proof of age — until then, the officer’s judgment stands. Amended by: Ordinance 424 (March 3, 1993) Ordinance 455 (October 28, 1995) Ordinance 494 (November 27, 2000) Note: This curfew does not apply to minors who are accompanied by a responsible adult or attending approved activities. Parents or guardians permitting violations can also be held accountable under §5-102.
