Overview of Public Water System Regulations

This document outlines the regulations for the public water system within the Borough of Ebensburg. It establishes who manages the system, how rules are enforced, and the penalties for violations.

Management and Authority

• Council Responsibility: The Council of the Borough of Ebensburg has exclusive charge and management of the water system.
• Borough Manager's Duty: The Borough Manager is required to report any violations of water system rules or breaches of contracts related to the system to the Council.
• Consumer Obligations: All consumers taking water from the Borough are bound by these provisions and any rules made by the Borough.

Rules, Rates, and Fees

• Adoption of Rules: The Municipal Authority adopts rules and regulations governing the water system by resolution.
• Enforcement: The Borough Council enforces these rules as the manager of the system.
• Financial Schedules: The Municipal Authority also adopts schedules for water rates, tapping fees, and fire service charges by resolution. The Borough Council applies these rates and fees.

Public and Non-Profit Use

• No Free Service: There is no free service rendered by the water system.
• Mandatory Payment: All public corporations, charitable or nonprofit institutions, school districts, and other political subdivisions must pay for the use of water services and facilities according to the established schedule.

Penalties

Violations of this part of the ordinance carry specific penalties:

• Fines: Convicted persons, firms, or corporations may be sentenced to pay a fine of not more than $600 plus costs.
• Imprisonment: In default of payment, a term of imprisonment not to exceed 30 days may be imposed.
• Daily Offenses: Each day a violation continues constitutes a separate offense.
