Chapter 12: Parks & Recreation Regulations This document outlines the rules and regulations for the use of parks and recreational areas within the Borough. Definitions PARK or PARKS: Includes all parks, playgrounds, recreation areas, tennis courts, beaches, structures, facilities, and any land or property under the Borough Council's jurisdiction for park purposes. PERSON: Any natural person, corporation, organization, company, association, or partnership. RULES AND REGULATIONS: Rules promulgated by the Borough Council. Park Hours Parks are open daily at hours designated by the Borough Council. No person is permitted in a park between 11:00 p. m. and sunrise unless special permission is granted by the Borough Council or Recreation Board. Prohibited Conduct The following actions are prohibited in any park: Damaging or removing trees, plants, turf, buildings, signs, fixtures, or other Borough property. Littering; waste must be disposed of in designated receptacles. Starting fires except in designated fireplaces or areas. Removing benches, seats, tables, or other appliances without permission. Injuring or removing posted notices or rules; no unauthorized signs may be posted. Setting up booths, stands, or tables for sale of articles/services without permission. Operating vehicles, bicycles, or conveyances except in designated areas or in a reckless manner. Operating commercial vehicles unless providing authorized services. Playing ball, swimming, golfing, pitching horseshoes, archery, camping, launching boats, or using metal detectors except in designated areas. Disrobing or changing clothes except in designated buildings or facilities. Disturbing the peace to annoy other users. Operating snowmobiles, minibikes, motorcycles, or other recreational vehicles except on designated roads, trails, or areas. Using threatening, abusive, insulting, profane, or obscene language. Committing disorderly or immoral acts. Holding public meetings, rallies, or special events without compliance with Chapter 10 (Licenses & Permits). Disobeying orders from police officers, Borough Council members, Recreation Board members, or other authorized persons. Hunting, capturing, or killing wild birds or animals. Allowing pets to run at large out of control. Animal Restrictions: Animals are prohibited in the following specific locations: Center Ward Playground (bordered by Cherry, Alton, and Milton Streets) East Ward Playground (bordered by Ogle, Triumph, and Caroline Streets) Memorial Field (bordered by West, Ogle, Marian Streets, and the former railroad) Exception: This rule does not apply to guide dogs for blind persons or dogs assisting other physically handicapped persons. Fishing All state laws pertaining to fishing apply in parks and recreation areas. Reservation for Specific Uses Park use is generally on a first-come, first-served basis. Reservations can be made for: League games (via annual permission from the Recreation Board). School or college athletic games, practices, contests, or exhibitions. Regularly scheduled school district or municipal recreation programs. Other specific requested uses (via permission from the Recreation Board). Authority to Close Areas The Borough Police Department may close recreation facilities that become hazardous due to weather, water, fire, or unforeseeable conditions. Tobacco-Free Zones The use of any tobacco product is prohibited in the following areas where children are present: Entire Property: East Ward Playground Center Ward Playground Memorial Field Young Peoples Community Center Lions Field Ebensburg Tennis Center Within 50 feet of the fenced area of Lake Field. Signs will be posted to delineate these areas. Enforcement and Penalties Enforcement: Borough police officers are responsible for enforcing these provisions. Penalties: Violation of any provision is punishable by a fine of up to $600 plus costs , and/or imprisonment for up to 30 days . Each day a violation continues constitutes a separate offense.
