Overview

The Borough of Ebensburg has enacted Ordinance #631 to regulate sanitary sewer connections and eliminate stormwater infiltration. The ordinance establishes strict rules for property transfers, requiring certification of sewage compliance before a sale can be finalized.

Key Regulations

• Prohibition on Illegal Connections: It is unlawful to construct, install, or maintain any connection that allows storm or surface water (such as downspouts or foundation drainage) to enter the sanitary sewer system. This applies to all properties, regardless of when the connection was originally made.
• Mandatory Certification for Sales: Before selling or transferring real estate within the borough, the seller must provide the buyer with a "Certificate of Sewage Compliance" or a "Temporary Certificate. "
• Municipal Lien Letters: The borough will require this certification before issuing municipal lien letters or property tax verification letters.

Definitions and Requirements

• Certificate of Sewage Compliance: An official statement from the Borough Manager confirming there are no illegal connections and that the customer facilities have passed an air pressure test. This certificate is valid for five (5) years.
• Temporary Certificate: A temporary certification issued under specific terms outlined in Section IV of the ordinance.
• Illegal Storm or Surface Water Connections: Defined as the discharge of ground/surface water, downspouts, roof drainage, or foundation/basement drainage into the sanitary sewer system.
• Sale: Includes any transfer of ownership, including inheritance and corporate transfers, with specific exemptions for refinancing without conveyance, certain trust transfers, and bona-fide marriage settlements.

Effective Date

This ordinance became effective on August 1, 2016. It was enacted and ordained on July 25, 2016.
