Ebensburg Borough Council Meeting Agenda Date: Monday, July 23, 2025 Time: 6:30 p. m. Borough Leadership Mayor: Randy Datsko Council President: Doug Tusing Vice-President: Cecilia Houser Members: Jeffrey Ball, Theresa Jacoby, Susan Kuhar, Robert Miller, Mike Murphy Key Agenda Items & Reports Consent Agenda (Routine Approvals) The following items are considered routine and will be approved by a single motion unless a council member requests separate discussion: Approval of Inframark reports for Wastewater and Water Treatment Plant Operations. Approval of minutes from the June 23, 2025 meeting. Approval of the financial statement for June. Approval of bills totaling $55,029. 40 for July 2025. Appointments & Public Comments Item 2A: Brandon Kopp will speak on behalf of VFW Post 4963 regarding the Gaming License Ordinance. Water, Wastewater & Stormwater Committee Item 6C (Waterline Replacement): Guyer Brothers has nearly completed the project and is working on punch-list items. Completion is anticipated within a few weeks. Item 6D (Stormwater Project): A. Liberoni Construction received substantial completion, except for work on Highland Avenue. Remaining work is expected to finish by the end of the week. Recreation Committee Item 7A (YPCC Moisture Issues): The YPCC is experiencing moisture problems similar to those at the Tennis Center. A proposal to line the ceiling with a membrane is estimated to cost $61,750 . Council agreed to put this out for bid; bids will be opened at the August meeting. Streets Committee Item 8A (Parking Enforcement): Following a January vote to move from metered to free two-hour parking, staff is developing an implementation plan with Borough Police. A recommendation will be presented next month. Item 8B (Rectangular Rapid Flashing Beacon): A contract was awarded to M and B Services, LLC. The project is expected to begin shortly and complete within 30 days of the start date. General Business & Ordinances Item 11A: Consider appointing Doug Tusing as a voting delegate for the resolutions Committee at the Municipal League annual Leadership Summit in October. Item 11B (Transient Retailer’s Ordinance): Staff recommends revising the current ordinance to focus only on door-to-door solicitation, as the current version is outdated and difficult to enforce. Item 11C (Gaming License Ordinance): The Solicitor has updated the proposed ordinance regulating Amusement and Gaming Devices. A letter from the American Legion Home Association of Ebensburg Post 363 expressing opposition has been noted. Item 11D (Zoning Changes): Consider changes to zoning for commercial uses including gaming parlors, hookah bars, marijuana dispensaries, CBD stores, vape shops, and tobacco stores. Item 11E (Zoning Map Change): Consider changing the zoning map for the north side of High Street between Beech to Spruce Streets from Residential Multi Household (RMH) to Mixed Village Commercial (MX/VC). Item 11F (Penn Eben Park): Council member Murphy suggested removing shade trees located between the gazebo and an adjacent building. Item 11G (Borough Pool Property): Council member Murphy suggested cutting back or removing vegetation along the stream behind the Borough pool. DEP permits may be required depending on the scope of work. Item 11H (Planning Commission Appointment): Consider appointing Bryan Hurtack to fill an unexpired term on the Planning Commission until December 2028. Department Reports Police Department: Chief Loughran submitted a written report on activities during the month. Public Works Department: Director Josh Surkovich submitted a written report on activities during the month. Community Development: Director Danea Koss submitted a written report on activities during the month. Recreation Department: Director Rebecca Williamson submitted a written report on activities during the month. Building Permit Enforcement: A monthly building permit report was forwarded to Council. Ebensburg Municipal Authority: Minutes from the last meeting are included in the packet. Code Enforcement: 9 violations were issued: 6 for shrubs/vegetation, 1 for nuisance vehicles/junk, 1 for feral cats, and 1 for junk on property. Other Items Executive Session: Discussion of a personnel matter.
